Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets forth guidelines for acceptable use of BaishanCloud North America Corp (“Baishan”) network, services, and products (collectively, “Services”) by our customers, resellers and other users of the Services (each, a "Customer"). The guidelines and restrictions in this AUP on use of the Services by a Customer shall apply equally to the Customer's employees and any other person or entity that is provided access to the Services directly or indirectly by the Customer ("Users"). By using the Services, customer acknowledges that it has read, understood and agrees to comply with the terms of this AUP. Customer shall (i) ensure that its Users comply with this AUP and (ii) be responsible for violations of this AUP by Customer or its Users.

Baishan reserves the right to modify this AUP at any time in its sole discretion. After the modification, we will inform you through on site announcement, on-site letter and other means. If you have any objection or are not acceptable, please do not continue to use this service. Any use of the Baishan Network and Services after such modification shall constitute acceptance of such modification.

Baishan takes no responsibility for any content created by Customers or Users, accessible or delivered on or through the Baishan’s network. Baishan does not monitor or exercise any editorial control over such content. Customer is solely responsible for (a) any content published or made available through the Baishan’s network by Customer and its Users and (b) compliance with all laws applicable to the publication and distribution of such content. Customer shall be solely responsible for maintaining a copy of its content.

In particular, but without limiting the more general prohibitions in this AUP, Customer shall not use the Services, or assist anyone else to:

  • Transmit, distribute or store information or material that, as reasonably determined by Baishan, is (a) inappropriate, obscene, defamatory, threatening, abusive, advocating violence, or which violates applicable federal, state, local, or international law or regulation; (b) harmful to or interferes with Baishan’s provision of Services or any third party's networks, equipment, applications, services, or websites (e.g., viruses, worms, Trojan horses, etc.); (c) would infringe, dilute, misappropriate, or otherwise violate any privacy, intellectual property, publicity or other personal rights including, without limitation, copyrights, patents, trademarks, trade secrets, or other proprietary information (including unauthorized use of domain names); (d) fraudulent or contains false, deceptive, or misleading statements, claims, or representations (such as “phishing”); or (e) violates generally accepted standards of Internet usage;

  •  Compromise or attempt to compromise the security of any Baishan or third-party network, system, server, or account; 

  • Send unsolicited or agreed to accept messages or postings, including bulk commercial advertising or informational announcements and "spam";

  • Impersonate or attempt to impersonate Baishan, Baishan personnel, another Customer or user, or any other person or entity; or

  • Violate the applicable acceptable use policies of other ISPs when data, content, or other communications are carried across the networks of such ISPs.

If Customer becomes aware of any content or activity that violates this AUP, Customer shall take all necessary action to prevent such content from being routed to or stored on the Baishan Network. To the extent Baishan becomes aware of any content or activities that Baishan deems, in its sole discretion, to be in violation of this AUP, Baishan may immediately block access to such content, suspend or terminate any affected Baishan Services, or take any other actions Baishan deems appropriate. Baishan shall be solely responsible for determining if any content or action violates this AUP. Baishan also reserves the right to cooperate with legal authorities and third parties in the investigation of alleged wrongdoing, including disclosing the identity of the party that Baishan deems responsible for the wrongdoing. Baishan may provide notice to Customer prior to suspension or termination of Baishan Services. Baishan shall not be liable for any damages of any nature suffered by any Customer, User, or any third party resulting in whole or in part from Baishan's exercise of its rights under this AUP.
